| 近日，股民维权律师收到广州市中级人民法院作出的首批勤上光电股票索赔案件判决结果，法院支持了投资者的索赔诉求！股民一审获得上市公司赔付金额没有打折，获赔比例接近100%！ 北京市盈科律师事务臧小丽律师告据记者，她刚刚拿到的是两位投资者的胜诉判决书，法院判决勤上光电在判决书生效后15日内向两名原告赔偿264321元。值得一提的是，该股票尚在索赔有效期以内，该判决的示范效果意味着其他同等条件的投资者只要加入索赔也可获赔，即在2013年1月8日—2014年12月1日期间买入勤上光电股票，并且在2014年12月2日后之后卖出或继续持有该股票的投资者可获赔。 两个时间段的勤上光电投资者皆可索赔 臧小丽律师介绍说，以往的虚假陈述赔偿案件，法院认可的赔偿范围往往只有一个时间段，即被证监会处罚的上市公司虚假陈述行为对应的揭露日期只有一个。 勤上光电因为虚假陈述两次受到证监会处罚，因此，对应的赔偿范围的时间段就有两个。勤上光电第一次受证监会处罚日期是2014年5月8日，中国证券监督管理委员会广东监管局行政处罚决定书(2014)4号认定，勤上光电未在招股说明书、2011年年度报告中将芭顿照明公司、品尚光电公司作为关联方予以披露，勤上光电招股说明书在披露 2009年度内销前五大客户时，未披露与松鼎贸易的交易情况，勤上光电关于媒体报道的澄清公告中否认与品尚光电存在关联关系，勤上光电上述行为违反了证券法第六十三条的规定，构成证券法第一百九十三条的行为，故对勤上光电予以处罚。 针对前述虚假陈述行为，广州中院判决支持赔偿的投资者是在2011年11月15日至2013年4月2日期间买入勤上光电股票，并且在2013年4月2日之后卖出股票的受损投资者。第一个索赔时间段对应的投资者索赔时效两年期限已经到期，该时段的索赔截止日期2016年5月12日，未参加索赔的投资者即使符合赔偿条件，也已经丧失胜诉权。 2015年3月18日，勤上光电第二次公告收到证监会罚单。中国证监会广东监管局20154号处罚决定书认定，勤上光电与勤上集团于2013年1月至2014年12月期间发生的直接和间接非经营性资金往来构成关联交易，勤上光电既未按照规定及时发布临时报告，也未在相关定期报告中对上述关联交易进行披露，违反了证券法规定，故对勤上光电进行处罚。针对该虚假陈述处罚事项，广州中院支持股民索赔诉求的范围是：在2013年1月8日至2014年12月1日期间买入勤上光电，并且在2014年12月2日后之后卖出或继续持有该股票的投资者。 法院不认可系统风险之说 虚假陈述索赔案件中，系统风险常常是上市公司提出不赔或者少赔偿的挡箭牌，勤上光电案也是如此。法院认为，勤上光电未能提供证据证明在勤上光电虚假陈述对应的期间，证券市场受到何种宏观经济因素的影响。其次，从证券市场的整体行情来看，勤上光电虚假陈述揭露日至准日期间内，深圳综指走势平稳，并未出现下行趋势。再次，勤上光电并未提交充分证据证明勤上光电股票的价格确实受到系统风险的影响。据此，法院认为勤上光电主张原告的损失受系统风险影响，依据并不充分，法院不予支持。另外，勤上光电主张原告损失受行业风险影响，法院同样不支持。 臧小丽律师介绍，依据法院以上的判决思路，她代理的案件中已经有2名投资者拿到胜诉，法院几乎是100%全额支持索赔诉求，未扣减所谓的系统风险等因素。 参加索赔的投资者应当准备的材料 投资者应向律师提供下列材料：买卖勤上光电股票的对账单或交割单原件(经证券公司营业部盖章)、证券账户开户确认单(经证券公司营业部盖章)、股民本人的身份证复印件、联系电话、电子邮箱及地址。律师首先将免费为提供材料的投资者确定是否符合条件，并计算是否存在损失。如果投资者符合起诉条件的，律师将提供进一步准备起诉的材料给投资者。
